By accessing, browsing, and/or using this Website, as well as by making any purchase of original artwork or derivative products, you (hereinafter, “the User” or “the Customer”) expressly and unreservedly accept these Terms and Conditions. If you do not agree with them, you must refrain from using this platform.
1. Purpose and Scope of the Website
The Website is a digital platform designed for the exhibition, promotion, positioning, and marketing of Teresa Espinosa’s artwork. The products available for purchase include:
- Original Work: Paintings, drawings, and one-of-a-kind pieces created directly by the artist.
- Reproductions and Limited Editions: High-quality prints (including Giclée prints) that are numbered, signed, or certified.
- Related Products and Accessories: Promotional items, merchandise, printed items, painting supplies, and painting kits.
2. Terms of Use for the Platform
The User commits to making lawful, diligent and correct use of the Website and its contents. It is strictly prohibited to introduce malicious code, carry out activities that saturate or damage the server infrastructure, or use automated mechanisms to extract data or content from the page without prior authorization.
3. Intellectual Property and Copyright Info
All works of art, images, photographs, illustrations, texts, logos, designs, graphic and audiovisual material, as well as reproductions in digital and physical formats (including, in a non-exhaustive manner: Giclée prints, prints, limited editions, promotional items and painting kits) that are displayed or commercialized on this website are the exclusive property of Teresa Espinosa and are protected by international intellectual property laws and current copyright legislation.
3.1. Reservation of Rights over the Original Work and Derivatives
The acquisition of an original work of art, a numbered reproduction or any derivative product through this platform does not transfer, under any circumstance, the rights of commercial exploitation, reproduction, alteration or distribution of the image to the buyer.
- The buyer acquires: The right of physical ownership over the acquired material support (the painting, the print or the object) for private exhibition and personal enjoyment.
- The artist retains: Exclusively and perpetually, all moral and patrimonial rights over the intellectual property, including the right to make future reproductions, editions or derivatives of the work.
3.2. Prohibited Use and Restrictions on Online Images
The copying, downloading, screenshotting, storage, manipulation, alteration, retransmission, distribution, marketing, or public exploitation of any image present on this website is strictly prohibited without the express, prior, and written authorization of Teresa Espinosa.
The images available in this digital catalog have copyright protection metadata and digital tracking systems. Unauthorized use of these visual files for commercial, advertising, or academic purposes (without citing the source), or for training Artificial Intelligence tools, constitutes a direct infringement of intellectual property laws and will lead to corresponding civil and criminal legal actions.
3.3. Licenses and Collaborations

4. Purchase Process and Pricing
- Prices: All prices are shown in the currency indicated on the screen and do not include shipping costs, which will be calculated transparently at checkout before finalizing the transaction.
- Data Accuracy: The Customer is responsible for providing complete and truthful shipping and billing information. We are not responsible for delays or losses resulting from incorrect addresses.
- Order Confirmation: Once payment is completed, the Customer will receive a confirmation email with the details of their purchase. In the case of original artwork or limited editions, the sale is subject to the final availability of the piece. In the unlikely event that a piece is not available, the Customer will be notified immediately and a full refund will be issued.
5. Payment Methods and Security
Commercial transactions are processed through secure and certified payment gateways that guarantee the encryption of the Customer's banking data. We do not store nor have access to the credit or debit card data used on the Website. Order processing will begin once the gateway successfully validates the transaction.
6. Shipping, Delivery, and Packaging Policies
- Specialized Packaging: We take the protection of every item extremely seriously. Original artworks and Giclée prints are packaged using professional materials specific to the conservation and transport of art, minimizing any risk of impact or moisture.
- Delivery Times: Processing and shipping times vary depending on the nature of the product (original artwork requires special logistical preparation, while made-to-order items or kits depend on production and distribution times). Estimates will be provided to the Customer during the purchase process.
- Customs and International Taxes: For shipments outside the country of origin, the Customer will be solely responsible for covering any tariffs, customs duties, or import taxes determined by the local authorities of the destination country.
7. Returns, Cancellations, and Claims Policies
- Products Damaged in Transit: If the package shows visible signs of damage upon delivery, the Customer must document the condition through photographs of the external and internal packaging immediately and contact our support team within no more than 48 hours of receipt.
- Original Artworks and Limited Editions: Due to the unique, collectible and exclusive nature of original works of art and limited edition prints printed on demand, no cancellations or returns are accepted due to change of mind once the order has been processed and shipped.
- Derivative Products and Kits: For promotional items or painting kits, returns shall be governed under the criteria of manufacturing defects, subject to validation by our quality control team.
8. Certificates of Authenticity
All original works of art and, where applicable, limited edition series or signed Giclée prints, are delivered accompanied by a Certificate of Authenticity signed by Teresa Espinosa. This document is the legal and historical proof of the provenance and originality of the piece, so we suggest that collectors keep it in a safe place together with the physical work.
9. Limitation of Liability
We make a constant effort to ensure that the color calibration of the images shown in the web catalog is as faithful as possible to the physical works. However, the User accepts that there may be subtle variations in tone, brightness or contrast depending on the technical configuration and the type of screen from which the Website is viewed.
10. Modifications and Applicable Jurisdiction
We reserve the right to modify, update or correct any part of these Terms and Conditions at any time to adapt them to new legislation or business dynamics. Modifications shall take effect immediately after their publication on the Website.
To resolve any dispute, conflict, or claim arising from the interpretation or execution of these terms, the parties expressly submit to the applicable legislation and the competent courts of the city of residence of the artist, waiving any other jurisdiction that might correspond to them by reason of their present or future domiciles.
